{"id":62836,"date":"2021-01-27T11:01:33","date_gmt":"2021-01-27T09:01:33","guid":{"rendered":"https:\/\/www.csregypt.com\/?p=62836"},"modified":"2021-01-27T11:01:33","modified_gmt":"2021-01-27T09:01:33","slug":"climate-litigation-cases-doubled-over-past-3-years","status":"publish","type":"post","link":"https:\/\/csregypt.com\/en\/climate-litigation-cases-doubled-over-past-3-years\/","title":{"rendered":"Climate litigation cases doubled over past 3 years"},"content":{"rendered":"<p dir=\"ltr\" style=\"text-align: left;\"><strong>\u00a0<\/strong>A <a href=\"https:\/\/www.csregypt.com\/en\/unep-sony-playstation-partner-to-incentivize-climate-change-friendly-lifestyle\/\">United Nations Environment Program (UNEP)<\/a> report\u00a0said climate cases have nearly doubled over the last three years and are increasingly compelling governments and corporate actors to implement their climate commitments, as well as pursue more ambitious climate change mitigation and adaptation goals.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">The report, published by UNEP in cooperation with the Sabin Center for Climate Change Law at Columbia University, shows climate litigation has become more common and more successful worldwide.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">In 2017, 884 cases were brought in 24 countries; as of 2020, cases had nearly doubled, with at least 1,550 climate change cases filed in 38 countries (39 including the European Union courts).<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">While climate litigation continues to be concentrated in high-income countries, the report\u2019s authors expect the trend to further grow in the global south \u2013 the report lists recent cases from Colombia, India, Pakistan, Peru, the Philippines and South Africa.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">The background of plaintiffs is becoming increasingly diverse as well, with NGOs and political parties joined by children, senior citizens, migrants, and indigenous peoples. Just as they are particularly vulnerable to COVID-19, those groups of plaintiffs often stand at the forefront of climate change, enduring extreme weather, rising sea levels, and pollution.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">\u201cCitizens are increasingly turning to courts to access justice and exercise their right to a healthy environment,\u201d said Arnold Kreilhuber, Acting Director of UNEP\u2019s Law Division. \u201cJudges and courts have an essential role to play in addressing the climate crisis\u201d.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">Some of the recent trends in climate litigation identified by the report include violations of \u201cclimate rights\u201d, i.e. cases are increasingly relying on fundamental human rights including the right to life, health, food, and water.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">In the coming years, UNEP expects climate litigation to increase in national and international bodies, especially with respect to companies misreporting climate risks, governments failing to adapt to extreme weather events, and cases brought to enforce previous court decisions. A rise is also expected in cases concerning persons displaced by climate change impacts.<\/p>\n<p dir=\"ltr\" style=\"text-align: left;\">&#8220;Climate litigation is a key lever for keeping governments and corporations on task in the fight to combat climate change,&#8221; said MIchael Burger, Executive Director of the Sabin Center for Climate Change at Columbia Law School. &#8220;And it is a powerful tool for holding them to account for their failure to do so.
